Underride Truck Accidents in Georgia

If you were injured in an underride truck accident in Atlanta Georgia, you may be facing catastrophic injuries, overwhelming medical bills, and serious uncertainty about your future. These crashes are among the most deadly collisions on Georgia highways, including I-285, I-75, and I-20. When your vehicle slides underneath a commercial truck’s trailer, the consequences are often devastating and permanent.

Understanding why these crashes are so dangerous and who can be sued under Georgia law is critical if you are considering hiring a personal injury lawyer.

What Is an Underride Truck Accident?

An underride accident happens when a passenger vehicle becomes lodged underneath the rear or side of a tractor-trailer. Because commercial trailers sit significantly higher than passenger vehicles, your car’s safety systems may not work as designed during impact.

Instead of your vehicle’s frame absorbing the force of the crash, the trailer can strike the windshield and roof area directly. This often results in traumatic brain injuries, spinal cord damage, severe facial injuries, or death.

Rear underride crashes frequently happen in stop-and-go Atlanta traffic. Side underride collisions often occur when a truck turns across traffic, changes lanes without sufficient clearance, or enters an intersection without properly yielding.

Why Underride Accidents Are So Deadly

Underride collisions are especially dangerous because of the height mismatch between large trucks and smaller vehicles. Passenger cars are built with crumple zones intended to absorb impact at bumper level. In an underride crash, the point of contact is often much higher.

When the trailer overrides the hood of your vehicle, the protective structure does little to shield you. The impact may occur at head or chest level, increasing the likelihood of fatal or permanently disabling injuries.

Large trucks also have significant blind spots. If a driver fails to check mirrors carefully before merging or turning, your vehicle may be forced underneath the trailer before you have time to react.

Georgia Laws That Apply to Underride Truck Accidents

Your claim will be governed by Georgia law if the crash occurred in Atlanta or elsewhere in the state.

Under O.C.G.A. § 51-1-2, ordinary negligence is defined as the failure to exercise ordinary care. Truck drivers and trucking companies have a duty to operate vehicles safely. If they breach that duty and cause injury, they may be held liable.

Georgia follows a modified comparative negligence rule under O.C.G.A. § 51-12-33. You may obtain damages if you are under 50 percent at fault. However, your compensation gets reduced by the percentage of fault which has been assigned to you. If you are 50 percent or more at fault, you can’t obtain damages.

Timing also matters. Georgia’s statute of limitations for personal injury cases is generally two years under O.C.G.A. § 9-3-33. If you fail to file within that time, you may lose your right to pursue compensation.

In cases involving defective equipment, claims may arise under Georgia’s product liability statute, O.C.G.A. § 51-1-11.

Who Can Be Sued After an Underride Truck Accident?

Many underride crashes involve multiple responsible parties. The truck driver may be liable for speeding, distracted driving, unsafe lane changes, following too closely, or failing to yield.

The trucking company may also be responsible. Employers can often be held liable for the negligence of drivers acting within the scope of employment. A company may also face direct liability if it failed to train drivers properly, ignored maintenance problems, or pressured drivers to meet unrealistic deadlines.

Sometimes the trailer is owned by a different company than the tractor. If poor maintenance or missing safety equipment contributed to the crash, that owner may also bear responsibility. Maintenance contractors may share liability if negligent repairs contributed to brake failure or lighting problems.

Some underride cases involve questions about trailer visibility or protective equipment. Certain safety standards for commercial trucks are established at the national level rather than by Georgia statute.

What Compensation Can You Recover?

If you were seriously injured, you may be entitled to compensation for medical expenses, lost wages, reduced earning capacity, rehabilitation costs, and pain and suffering.

In cases involving especially reckless conduct, punitive damages may be available under O.C.G.A. § 51-12-5.1, though availability depends on the specific facts of your case.

Because underride accidents frequently cause catastrophic injuries, damages can be substantial. Calculating the full value of your claim requires careful review of medical records, employment history, and long-term care needs.

Why Acting Quickly Matters in Atlanta Truck Accident Cases

Trucking companies and insurers often begin investigating immediately after a crash. Critical evidence, including electronic driving data, inspection records, and video footage, can disappear quickly if not preserved.

Taking action promptly allows your attorney to secure evidence, identify all responsible parties, and protect your rights under Georgia law before deadlines expire.
