Liability for Cherokee County Car Accidents
Car accidents remain one of the leading causes of preventable injury and death in the United States. According to the National Highway Traffic Safety Administration, “There were 716 fewer people killed in motor vehicle traffic crashes on U.S. roadways during 2022, a 1.7-percent decrease from 43,230 in 2021 to 42,514 in 2022. The fatality rate per 100 million vehicle miles traveled (VMT) decreased by 3.6 percent from 1.38 in 2021 to 1.33 in 2022.” Several factors will increase the odds of a motor vehicle collision.
- Distracted Driving: Many collisions involve a distracted driver. This can include situations where drivers are looking at their phones or reaching for an object that fell.
- Speeding: Drivers are substantially more likely to be involved in a collision if they are speeding. What many people don’t realize is that even traveling the speed limit could be dangerous, depending on the prevailing conditions of the roadway.
- Inclement Weather: Rain, snow, and ice on the roadway can impact vehicle stopping distances and make it much harder for drivers to slow down to avoid a collision.
Drivers must use caution in order to avoid colliding with other vehicles. This includes maintaining a safe distance with the vehicle ahead of them. Pursuant to GA Code § 40-6-49, the driver of a motor vehicle shall not follow another vehicle more closely than would be safe and prudent given the prevailing conditions on the roadway. If a driver fails to slow down to avoid colliding with another vehicle, this could form the basis of a negligence claim.
On certain occasions, liability for a collision could extend beyond any driver. For example, the company that manufactured a vehicle could potentially be held at fault. Companies have a legal obligation to ensure that their vehicles are reasonably safe. They must also take certain measures in order to prevent those vehicles from becoming potential fire hazards. If a vehicle has a defect that contributes to an accident, this could form the basis of a strict product liability claim.
There have been several lawsuits related to Chevrolet vehicles that have caught fire and seriously injured or killed vehicle occupants. Consider, for example, Baker v. General Motors Corp., 522 U.S. 222 (1998). A 1985 Chevrolet S-10 Blazer caught fire in an accident, which resulted in the death of the driver and passenger. Attorneys for the plaintiff argued that the fire was the result of a faulty fuel pump. A former GM engineer provided key testimony about the defective fuel pump. Following a trial, a jury awarded the plaintiffs $11.3 million in damages. It is important that several measures be taken after any fatal car accident.
- A police report of the accident should be conducted.
- Photos of the accident site should be taken.
- The circumstances leading up to the crash should be understood.
- Medical records related to any injuries should be preserved.
- It should be determined if vehicles involved were on any recall lists.
It can be difficult to know where to begin if you’ve been involved in a serious collision. Victims often need to take extensive periods of time away from work. They may also be left with high medical bills. In a fatal collision, family members may lose their primary breadwinner. Accident victims should understand that they do have legal rights. They are able to seek a measure of accountability through a wrongful death claim.
