► Who pays in a wrongful death case? 99% of the time the person paying the settlement or verdict in a wrongful death case is going to be insurance. That's especially true in an accident case where the at-fault driver's insurance or the uninsured motorist coverage or someone's commercial general liability policy or an excess or umbrella policy ends up paying the judgment.
► Very occasionally you'll see a private individual paying in a car accident case or a motorcycle accident case, but it's very rare. Normally that involves some public figure, some unusually rich person having caused a collision. It's almost always insurance.
► But there are occasions where the payor in a wrongful death case is the defendant, that is the individual or the company that caused the death. Most of the time we see that in larger cases involving huge defendants, like Federal Express, Werner Trucking, Ford Motor Company, Home Depot, just like that. Almost always it's insurance.
