► Who pays the settlement or the verdict in a sexual assault or rape case? It's a smart question to ask because we are civil lawyers. We bring civil lawsuits, usually for money damages. And if we take a case, and we win it for you, then at the end of the day what we have is a piece of paper from a court allowing us to collect money on your behalf from something, some company, some insurance company, or some individual. But if that something, company, insurer, individual, doesn't have any money, then the piece of paper that we have allowing us to collect it is essentially worthless. So unfortunately, it's wise to think before you start about whether there is money at the end of the road to be collected.
► Most of the time, the payor, that is the person or entity paying the settlement or verdict in a sexual assault or rape case is going to be a company or an insurance company or their insurer. That can happen in a number of ways. We've handled cases in which a hotel failed to take reasonable precautions to keep its guests safe. We've handled cases against psychiatric institutions who allowed their patients to be raped by people who work there. We've handled cases against restaurants and other workplaces where managers took sexual advantage of the people who work for them. We've handled cases against apartment complexes. So oftentimes there is a larger company, usually accompanied with insurance, from whom to collect in a sexual abuse or rape case.
► Not always. There are sometimes where the payor of a settlement or verdict is the individual attacker. Now that is rare. Sometimes you have an individual attacker who actually has assets, could be a professional athlete or some C-level person at a huge company or something like that. But most of the time, unfortunately, the individual attackers who commit sexual assaults or rapes are losers, and they don't have a lot to their name. So they are broke. And if they're broke, a judgment against them doesn't do anybody any good.
