► Hi, my name's Matt Kahn. I'm an attorney with Butler Law Firm. Today, we're going to talk about who pays a verdict or a judgment in a personal injury case.
► If you've been involved in a personal injury case or you've been on a jury, you've likely seen one of these, which is just the case style of a complaint. Here we have Jane Doe versus John Smith. In Georgia and in most states, you aren't allowed to sue the insurance company. You have to sue the insured and prosecute the case against the individual.
► But it's important to remember that the insurance company is the entity that is going to be paying any verdict or judgment. In trials, you're not allowed to talk about insurance because the civil rules in Georgia preclude that, but at the end of the day, the reason that a case is going to trial is because an insurance company like Allstate or State Farm, Progressive or Geico is not paying what the case is worth. And so when the plaintiff asks you to award money for his or her injuries, just remember that one of these guys is going to be footing the bill.
