► In a case of wrongful death or when someone dies, do you bring a criminal case or a civil case? Well, sometimes both, but there are differences. A criminal case involves, normally, prison time for the person who caused the death, and a criminal case is brought by the government, either the prosecutor for the state or the prosecutor for the federal government. Now, the prosecutor will usually talk with the victim's family and take their wishes into account. But whether to bring the case and what to do with the case once it has been brought is ultimately a decision for the government.
► Sometimes at the same time that a criminal case is ongoing or even if there is no criminal case, you can bring a civil case. That's the kind of case that my law firm would help with. A civil case is about money, financial compensation for the wrong done, for the loss of life, and a civil case is brought by private individuals who have a right to recover or a right to bring the claim, usually through the help of a lawyer or a law firm.
