Who Pays Medical Bills After a Roswell Car Accident

The short answer is that the at-fault driver’s insurance company usually does not pay those bills as they come due. When treatment is provided this way, Georgia’s medical lien laws may apply. O.C.G.A. § 44-14-470 through O.C.G.A. § 44-14-477 allow certain hospitals and healthcare providers to claim part of a future settlement to help ensure they are paid for accident-related treatment. For an injured person, the practical effect is simple: a provider may be willing to treat you now and wait to be paid later.

Can Medical Bills Go to Collections Before Settlement?

Yes. A pending personal injury claim does not automatically stop medical providers from seeking payment. Hospitals, physicians, and collection agencies generally expect bills to be paid according to normal billing procedures even if your accident claim is still pending.

What if the Driver Who Hit You Has No Insurance or Not Enough Insurance?

Serious accidents can create medical expenses that exceed available liability insurance coverage. Although Georgia requires motorists to maintain liability insurance under O.C.G.A. § 33-34-4 and maintain proof of insurance under O.C.G.A. § 40-6-10, minimum policy limits are often not enough to cover serious injuries.

O.C.G.A. § 33-7-11 allows Georgia drivers to purchase uninsured and underinsured motorist coverage. If the driver who hit you has little or no insurance, this coverage may help pay losses that the at-fault driver’s policy does not cover.

Who Ultimately Pays Medical Bills if Another Driver Caused the Accident?
