Liability for Atlanta Pedestrian Accidents
Pedestrians are uniquely vulnerable to the hazards posed by motor vehicles. According to the National Safety Council, “Pedestrian fatalities as a percent of all traffic fatalities increased steadily from 2005 through 2018, from 11.2% to 17.3%, respectively. The percentage of pedestrian deaths has now increased for three consecutive years, accounting for 17.9% in 2023.” Drivers should take several measures in order to avoid hitting pedestrians.
- Remain Alert: Drivers should refrain from common distractions that cause accidents, including looking at their cell phones or texting while driving.
- Speed: Drivers must always operate their vehicle at a safe speed. This may necessitate that they travel well below the stated speed limit, depending on the prevailing weather conditions.
- Blind Spots: Drivers should check their blind spots before making turns at an intersection.
Pursuant to Georgia Vehicle Code § 40-6-93, every driver of a vehicle shall exercise care to avoid colliding with any pedestrian and shall give warning of their presence by sounding their horn when necessary. Drivers should be particularly cautious around any obviously confused, incapacitated, or intoxicated person. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries.
- Broken Bones: The force of being hit by a car with no protection often results in broken bones and serious fractures.
- Spinal Cord Trauma: One of the most serious and consequential injuries that a person may sustain in a pedestrian accident is damage to their spinal cord. These injuries can result in temporary or permanent paralysis.
- Head Injuries: Even a low-speed pedestrian accident can result in a head injury if a person hits their head against the vehicle or the ground after being knocked over. Victims of head injuries are at greater risk of neurodegenerative illnesses.
The vast majority of pedestrian accidents are totally preventable. They tend to occur when drivers are simply not paying adequate attention to the road ahead of them. Speeding is another major problem. Drivers are substantially more likely to lose control of their vehicle at higher speeds. Any person injured in a pedestrian accident due to the negligence of a driver may be able to seek some measure of accountability through a bodily injury claim.
