Liability for Byron Car Accidents
Bicycles are uniquely vulnerable to the hazards posed by motor vehicles. According to the National Highway Traffic Safety Administration, “Bicyclist injuries remain consistently, disproportionately high. In 2021 an additional estimated 41,615 bicyclists were injured. Over the last 5 years, estimated injury-only crashes averaged about 45,400 yearly.” Drivers should take several measures in order to avoid injury collisions.
- Scanning: Drivers should consistently scan the road ahead of them in order to identify and avoid potential hazards.
- Fatigue: Drivers should ensure that they are well rested before heading out onto the road.
- Distraction: Drivers should avoid looking at their phone or engaging in any activity that consistently takes their eyes off the road.
All drivers in Illinois have a legal obligation to exercise due care in order to avoid colliding with any pedestrian or bicyclist in the roadway. Pursuant to GA Code § 40-6-93, every driver shall use caution to avoid colliding with any pedestrian in the roadway. They must use their horn when necessary and be extra cautious in order to avoid hitting any child or obviously confused person. If a driver fails to slow down to avoid hitting a cyclist, this could form the basis of a negligence claim.
Depending on the facts of any case, it is also possible that there could be numerous liable parties for a pedestrian accident. For example, if a vehicle was being used for commercial purposes, the company that employed the negligent driver could potentially be held at fault. As a general principle, employers are vicariously liable for the wrongful actions of their employees. Victims of bicycle accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
The vast majority of bicycle accidents are entirely preventable. They tend to involve situations where drivers are traveling too fast for the prevailing conditions. Unfortunately, insurance companies will often do everything in their power to avoid taking responsibility if one of their drivers is involved in a collision. This is why it is so important that accident victims seek the guidance of an experienced Atlanta bicycle accident attorney.
