Liability For Georgia Teacher Sexual Abuse

Sexual abuse involving teachers and coaches is far more common than many people may realize. There is a particularly large among of abuse that takes place in competitive cheerleading. According to one report by Vice, “For years, the U.S. competitive cheer scene has been roiled by allegation after allegation that cheer officials sexually abused minors and then attempted to cover it up.” There are a number of steps that school should take in order to prevent student sexual abuse.

  • Schools should conduct a thorough background check on all teachers, coaches and employees.
  • Schools should have clear guidelines related to appropriate behavior between teachers and students.
  • Schools should thoroughly investigate all allegations of misconduct.

Depending on the facts of any case, a school district could be liable if a teacher or coach sexually abuses a student. Schools have a legal obligation to protect students from reasonably foreseeable sources of harm. This includes protecting them from sexual abuse at the hands of school employees. If school officials knew that a teacher posed a risk of harm to students and failed to act, this could form the basis of a negligence claim. There are many steps that should be taken after any instance of suspected sexual abuse involving a teacher.

  • A police report of the incident should be created.
  • Eye witnesses should be interviewed.
  • School records related to the defendant should be sought.
  • Medical records related to the incident should be preserved.
  • An experienced students sexual abuse attorney should be consulted

Georgia law requires teachers and other school administrators to notify law enforcement when they have reason to believe that a child is being abused. But this does not always happen. Indeed, by the time any teacher or coach is arrested for sexual abuse, there were likely numerous red flags that were missed. The family of any student that is sexually abused by a school employee may have legal recourse through a civil claim. A teacher sexual abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
