Liability for Clayton County Semi-Truck Accidents

Truck drivers are required to obtain a commercial driver’s license. They are expected to operate with an abundance of caution to avoid colliding with other vehicles or pedestrians on the roadway. According to GA Code § 40-6-180, “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard for the actual and potential hazards then existing.” Semi-trucks can be particularly dangerous for several reasons.

  • Blind Spots: Semi-trucks have large blind spots all around the vehicle. These can obscure the presence of pedestrians.
  • Ground Clearance: Semi-trucks have a high ground clearance, which can lead to pedestrians being pulled underneath the truck.
  • Weight: Semi-trucks can weigh 80,000 pounds and are therefore extremely dangerous even at lower speeds.

Truck drivers must slow down to avoid colliding with any pedestrian in the roadway. Even if a pedestrian is in the middle of a road, this does not relieve a driver of their duty of care to slow down to avoid a collision. When truck drivers fail to take evasive action to avoid colliding with a pedestrian, this could be construed as negligence. Liability for the collision could extend to the company that owned the truck or employed the truck driver.

Steps to Take After Clayton County Semi-Truck Accidents

Thousands of pedestrians are seriously injured or killed every year in preventable car accidents. According to the Governors Highway Safety Association, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” Certain actions should be taken after any pedestrian accident.

  • The police should be called to the scene of the accident to help all of the victims.
  • Photos of the accident site should be taken.
  • Medical records for related injuries should be sought.
  • The nature and purpose of the truck driver’s trip should be understood.
  • The history of collisions on the road or intersection where the accident took place should be investigated.
  • The family of any person who died should request an independent review by a team experienced in accident reconstruction.

Pedestrians have a naturally small profile and lack the protections of enclosed vehicles. Drivers must be particularly cautious when any pedestrian is nearby. But far too often this does not take place. Unfortunately, truck companies and their insurance providers will almost never accept responsibility when a person is injured in a truck accident. Evidence preservation is a critical component of holding all responsible parties accountable.
